Terms of Service

1. Acceptance of Terms

By accessing or using engiCAD Transfer ("Service") at transfer.engicad.io, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the new Terms.

2. Description of Service

engiCAD Transfer provides a file transfer service that allows users to:

• Upload files for temporary storage and sharing
• Send files to recipients via email notifications
• Download files shared with them
• Request files from others (registered users)

The Service is provided "as is" and we reserve the right to modify, suspend, or discontinue any aspect of the Service at any time.

3. User Accounts

3.1 Account Registration

You may use the Service without an account (with limited features) or create a free account for enhanced features. When creating an account, you must:

• Provide accurate and complete information
• Maintain the security of your password
• Notify us immediately of any unauthorized access
• Be at least 16 years of age

3.2 Account Responsibilities

You are responsible for all activities that occur under your account. We are not liable for any loss or damage arising from your failure to protect your account credentials.

4. Acceptable Use

You agree NOT to use the Service to:

• Upload, share, or distribute any illegal content
• Share malware, viruses, or other harmful software
• Infringe on intellectual property rights of others
• Share content that is defamatory, obscene, or harmful
• Harass, threaten, or abuse other users
• Attempt to gain unauthorized access to our systems
• Use the Service for spam or unsolicited communications
• Circumvent usage limits or quotas
• Use automated systems to access the Service without permission
• Share child sexual abuse material (CSAM) - we actively scan for and report such content

5. Content and Files

5.1 Your Content

You retain ownership of files you upload. By uploading files, you grant us a limited license to store, process, and transmit your files solely to provide the Service.

5.2 Content Scanning

We scan all uploaded files for:

• Malware and viruses
• Potentially dangerous file types
• Other harmful content

We may reject or remove files that fail these scans.

5.3 Content Removal

We reserve the right to remove any content that violates these Terms, without prior notice. We may also be required to remove content pursuant to valid legal requests.

6. Usage Limits

The Service has the following usage limits:

• Unregistered users: 1 GB per month transfer quota
• Registered users: 5 GB per month transfer quota
• Maximum file size: 2 GB per file
• File retention: 1-30 days (as selected by sender)

We reserve the right to modify these limits at any time.

7. Intellectual Property

The Service, including its design, features, and content (excluding user-uploaded content), is owned by engiCAD and protected by intellectual property laws. You may not copy, modify, or reverse engineer any part of the Service.

8. Privacy

Your use of the Service is also governed by our Privacy Policy. Please review it to understand how we collect and use your information.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability or fitness for a particular purpose
• Warranties that the Service will be uninterrupted or error-free
• Warranties regarding the security or integrity of files

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• We are not liable for any indirect, incidental, special, or consequential damages
• We are not liable for any loss of data, profits, or business opportunities
• Our total liability shall not exceed the amount you paid for the Service (if any)

Some jurisdictions do not allow limitation of liability, so these limitations may not apply to you.

11. Indemnification

You agree to indemnify and hold harmless engiCAD from any claims, damages, or expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Content you upload or share through the Service

12. Termination

We may terminate or suspend your access to the Service at any time, without prior notice, for any reason, including:

• Violation of these Terms
• Suspected fraudulent or illegal activity
• Extended periods of inactivity

You may terminate your account at any time by contacting us or using the account deletion feature.

13. Governing Law

These Terms are governed by the laws of Malta, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Malta.

If you are a consumer in the European Union, you may also have the right to bring proceedings in your country of residence.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and engiCAD regarding the Service.
